The workshop will provide a refresher on the CCDC 02 – Stipulated Price Contract which is a standard prime contract between Owner and prime Contractor that establishes a single, pre-determined fixed price, or lump sum, regardless of the Contractor’s actual cost.
5A and 5B 2010 Construction Management Contracts will also be discussed – and the differences between the two versions. The course will also consider and discuss CCDC 14 Design-Build Stipulated Price Contract – a standard prime contract between the Owner and the Design-Builder where the Design-Builder provides the Design Services and performs the Work under one agreement, for a single, pre-determined stipulated or fixed price.
In addition to the contracts noted above, this session will highlight some of the typical provisions contained in construction contracts and examine how different risks are allocated throughout the contract. This session will also feature a discussion on commonly litigated provisions of contracts, making reference to recent decisions in NL and elsewhere.
